These Terms of Use ("Terms" or “Terms of Use”) regulate your relationship with the www.globallytaught.com website (the "Service") operated by Anne C. Wilcox ("us", "we", or "our").

Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned by your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. This site is intended for users who are 18 years of age or older. 

By accessing or using the Service, you signify that you have read, understood, and agree to be bound by these Terms, and to the collection and use of your information as set forth in the Privacy Policy, whether or not you are a registered user of our Service. This Agreement applies to all visitors, users, and others who access the Service ("Users"). By accepting this agreement, or making use of these services, you warrant that you have reviewed and understand all terms and policies.

We may, in our sole discretion, modify or update these Terms from time to time, and so you should review these Terms and incorporated policies periodically. Such changes shall be made at our discretion. Any changes to our Terms and Policies, or this agreement, shall be denoted by modification of the “Date Last Changed” at the top of this page. 

THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION OF DISPUTES PROVISION THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS, AND ALSO LIMITS THE REMEDIES AVAILABLE TO YOU IN THE EVENT OF A DISPUTE.

Refund Policy

In general, due to the nature of electronic media, all sales of products are final – no refunds. However, there are certain, limited exceptions in which a refund would be warranted. If your purchase falls into one of the following exceptions listed below, you may be eligible for a refund.  Any refund request meeting one of the exceptions below must be submitted by contacting us via our Contact page within six months from the date of purchase, so long as the product was purchased at www.globallytaught.com.

  • Compromised Resource File— A resource file is damaged or is missing content. This does not include technical limitations addressed in the product description, for example, needing to download free software, like Adobe Acrobat Reader, to access the files.

  • Technical Limitations— You are unable to access a resource because the technical requirements aren't included in the product description.

  • Duplicate Purchase— You purchase the same resource twice in one account. For example, you purchased our World Geography Unit, then later purchased our Curriculum Bundle, which contains the World Geography Unit, within six months of the original purchase.

User License

Purchase of a product entitles the purchaser the right to reproduce the pages for a single classroom use only. Duplication for another teacher, grade level team, an entire school, an entire school system or commercial purposes is strictly forbidden without prior written permission from Globally Taught.  (Except that a substitute teacher in your classroom may use the purchased materials while teaching in your classroom.)  Additional user licenses are available for purchase through TeachersPayTeachers.com; one additional license per additional user must be purchased. Only by purchasing additional user licenses may multiple teachers share this product.

Intellectual Property

The Service, including all information, original content, copyrights, trademarks, features, and functions are and will remain the exclusive property of Anne C. Wilcox of Globally Taught. The Service is protected by copyright and other laws of both the United States and foreign countries. Your use of the Service does not grant you ownership rights to the contents of the Service. Reproducing content from the Service in any form (including but not limited to on another website) of any part of the Service (including but not limited to content, images, and designs) without the prior written consent of Anne C. Wilcox at Globally Taught is strictly prohibited.

You may provide links to the Service as long as:
1) You clearly give credit to the Service as the author, creator, and producer 
2) You include hyperlinks directly to the Service
3) You do not remove or obscure any portion of the Service by framing or any other means of distortion 
4) Your website does not engage in illegal activities
5) You follow legal, fair, and ethical use of the Service and do not damage the reputation of the Service in any way or take advantage of the Service for financial gain

You may not provide links to the Service that suggests any form of association, endorsement, or approval from the Service without prior written consent. You may not provide links from any website that is not owned and operated by you. You must cease providing links to the Service immediately upon request from the Service. Requests for prior written consent should be addressed to Anne C. Our Service may contain links to third-party web sites or services that are not owned or controlled by Anne C. Wilcox at Globally Taught. Anne C. Wilcox shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including and without limitations, if you breach the Terms of Use. Upon termination, your right to use the Service will immediately cease.

Limitation of Liability

In no event shall Anne C. Wilcox, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Globally Taught, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Texas, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.

Digital Millennium Copyright Act (DMCA)

Just as we ask others to respect our intellectual property rights, we respect the intellectual property rights of others. If you believe content located on or linked to by our website violates your copyright, you are encouraged to notify us. Children’s Online Privacy Protection Rule (COPPA)

We comply with the requirements of the federal Children’s Online Privacy Protection Rule (COPPA).  We do not specifically market to children under the age of 13; our website is directed to people who are at least 13 years old or older.  We do not knowingly collect any information from anyone under 13 years of age.

Customer Reviews

Customers who make purchases from the Service may be sent an invitation for a product review. Review invitations may be sent on behalf of Globally Taught by an independent third-party for the collection and verification of reviews. By purchasing and/or downloading any materials from Globally Taught, you consent to receive review invitations from the Service and/or a third party review collector.

Globally Taught may also send requests for reviews upon purchase of our products. By purchasing and/or downloading any materials from the Service, you are consenting to receive direct email from Anne C. Wilcox and/or the Service.

Your review(s) may be used in other areas of Globally Taught to promote the Service. Reviews may be used in email newsletters, social media (Instagram, Facebook, YouTube, etc.), and on www.globallytaught.com.

Arbitration

READ THIS SECTION CAREFULLY BECAUSE IT REQUIRES THE PARTIES TO ARBITRATE THEIR DISPUTES AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM COMPANY. For any dispute with Globally Taught, you agree to first contact us at annie@globallytaught.com and attempt to resolve the dispute with us informally or according to the Terms of Use.  In the unlikely event that Globally Taught has not been able to resolve a dispute it has with you after attempting to do so informally, we each agree to resolve any claim, dispute, or controversy (excluding any Globally Taught claims for injunctive or other equitable relief) arising out of or in connection with or relating to this Agreement, or the breach or alleged breach thereof (collectively, "Claims"), by binding arbitration.

Where it is reasonably believed the relief sought is $25,000 or less, and the claim is appropriate to resolve in small claims court, the arbitration will be conducted by FairClaims ( http://www.fairclaims.com/) in accordance with its Arbitration Rules & Procedures effective at the time a claim is made. The award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys' fees and reasonable costs for expert and other witnesses, and any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Section shall be deemed as preventing Globally Taught from seeking injunctive or other equitable relief from the courts as necessary to protect any of Globally Taught’s proprietary interests.
